Types of Information the UPD Cannot Release

Federal and state laws govern public access to government records. Exemptions and legal limitations permit denying access to records or portions thereof that, if released, would:

  • Interfere with an investigation or judicial proceeding
  • Deprive a person of a right to a fair trial or impartial adjudication
  • Endanger the life or safety of any person
  • Interfere with police operations
  • Identify a confidential source or disclose confidential information relating to a criminal investigation
  • Identify children under 18 years of age who are complainants or arrestees, except when arrested for a crime as a result of which they would be classified as a Juvenile Offender (Penal Law Sec. 10.00), sub 18)
  • Reveal criminal investigative techniques or procedures, except routine techniques and procedures
  • Release information about victims of a sex crime
  • Constitute an unwarranted invasion of personal privacy
